FragranceNet is dedicated to securing the data of our customers and your rights under the California Consumer Privacy Act of 2018 (“CCPA”).

This Privacy Notice for California Residents (the "Notice") supplements the posted general Privacy Policy for FragranceNet.com, Inc. (the "Company") and applies to all visitors, users, and others who reside in the State of California ("consumers" or "you"). Along with information on the data we collect, this policy explains your rights under the CCPA and has instructions and contact information to help youexercise these rights.

Information We Collect:

Depending on our use of our site and services, we may have collected the following categories of personal information within the last twelve (12) months:

We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device ("personal information"). Personal information does not include: publicly available information and information excluded from the CCPA's scope, like: health or medical information or personal information covered by other privacy laws, including the Fair Credit Reporting Act (FCRA) or the Gramm-Leach-Bliley Act (GLBA).

The Company obtains the categories of personal information listed above from the following categories of sources:

  • When establishing an account with us, placing an order on our Website;
  • When you visit our Website and use our Services.
  • When you participate in our forums, surveys, contests, sweepstakes, promotions, content submissions, chats, bulletin boards, discussion groups, requests for suggestions, and membership registrations.
  • When you report a problem with our Website.
  • Records and copies of your correspondence (including e-mail addresses), if you contact us, including email, voice and chat transcripts.
  • Your search queries on our Website.
  • When you communicate with any or our departments such as customer service, sales or technical services.
  • When you use certain payment methods.
  • Third-party advertising and marketing companies.
  • Service providers, who help us maintain and provide the Website and Services.
  • Service providers, who help us provide advertising and track customer interactions on our Website and through advertisements.

Use of Personal Information:

We may use or disclose the personal information we collect for one or more of the following purposes:

  • To allow you establish an account with us.
  • To protect us from misuse of our websites and fraudulent orders.
  • To process the return of the products and the refund of purchase prices.
  • To invite you to review our products.
  • To remind you of any purchasing processes you have not yet completed.
  • To allow you to participate in interactive features on our Website.
  • To provide our Website, Services and content to you and to promote the stability and security of our Website, Services and content.

This includes sending you newsletters, marketing emails and to inform you about our products, services and promotions, and notifying you about changes to our Website.
  • To understand and know how our products work and sell, the effectiveness of our marketing campaigns, the effect of our websites and the overall user experience and to generally improve our product strategy and user experience design.
  • To provide certain forms of functionality throughout our Website (such as to save your cart when you leave our Website) including providing a localized version of the Website. To allow you to customize the direct marketing sent to you based on your preferences/interests.
  • To show you individual recommendations on our Website based on this data. When you visit our website, cookies and similar tracking technology (e.g. "Pixels") are set by our retargeting provider(s) to track which products you have viewed or purchased on our Website. Using this information, we may then show you individual offers of products on third-party websites through our retargeting provider(s) and analyze the results to further improve our ads.
  • To generate personas, personal preferences, market trends from algorithmic and language processing/analysis.
  • As described to you when collecting your personal information or as otherwise set forth in the CCPA.

We may also use or disclose the personal information we collect to enforce and/or defend our rights and to the extent necessary for any resulting legal dispute; to perform risk assessments such as due diligence investigations; and to respond to law enforcement requests and as required by applicable law, court order, or governmental regulations; To evaluate a sale or transfer of some or all of our assets, which personal information held by us about our customers is among the assets transferred.

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

Sharing Personal Information:

We may disclose your personal information to a third party for a business purpose. When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract. We share your personal information with the following categories of third parties:

  • Service providers (such as IT services, and website hosting companies).

  • Third-Party Marketing Partners.
  • Third-Party Service Providers.

Disclosures of Personal Information for a Business Purpose: In the preceding twelve (12) months, the Company has disclosed the following categories of personal information for a business purpose:

Category B: California Customer Records personal information categories.

Category C: Protected classification characteristics under California or federal law (i.e. Date of Birth).

Category D: Commercial information.

Category E: Internet or other similar network activity.

Category F: Geolocation data.

We disclose your personal information for a business purpose to the following categories of third parties:

  • Service providers (including such as IT services, and website hosting companies).
  • Third-Party Service Providers.
  • Credit card companies.
  • Third-Party Marketing Partners.
  • Advertising and Marketing Partners.
  • Analytics Companies.
  • Shippers.
  • Other companies within the FRAGRANCE.COM Group as part of a group-internal, collaborative process, as needed.

Sales of Personal Information:

Cal. Civ. Code § 1798.140 (t)(1) defines "sell" as selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer’s personal information by the business to another business or a third party for monetary or other valuable consideration. In the preceding twelve (12) months, the Company has "sold" the following categories of personal information to third parties:

Category C: Commercial information.

Category D: Internet or other similar network activity.

Category E: Geolocation data

We "sell" (see definition above) your personal information to the following categories of third parties:

Your Rights and Choices:

To exercise the rights described in this section, please submit a request to us by either:

The verifiable consumer request must: provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and describe your request with sufficient detail that allows us to properly understand, evaluate, and respond.

Please note that your request is subject to verification, and that we are not obligated to provide personal information in response to such a request if a consumer makes more than two requests in a 12-month period. Making a verifiable consumer request does not require you to create an account with us. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information.

  1. Access to Specific Information and Data Portability Rights:You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past twelve (12) months. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will disclose to you:
    • The categories of personal information we collected about you.
    • The categories of sources for the personal information we collected about you.
    • Our business or commercial purpose for collecting or selling that personal information.
    • The categories of third parties with whom we share that personal information.
    • The specific pieces of personal information we collected about you (also called a data portability request).
    • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing: sales, identifying the personal information categories that each category of recipient purchased; and disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.
  2. Deletion Request Rights:You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:
    • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.
    • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
    • Debug products to identify and repair errors that impair existing intended functionality.
    • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
    • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
    • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
    • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
    • Comply with a legal obligation.
    • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
  3. Do Not Sell My Personal Information:You have the right to request to opt-out from future “sales” of your personal information. The law defines “sale” very broadly to include simply making data available to third parties in some cases. We let advertising and analytics companies collect IP addresses, and cookie IDs through our sites and apps when you use our Services. We also disclose personal information to the companies that provide products and services to our members for their own marketing purposes. After you submit your Do Not Sell request, we may continue to share some personal information with our suppliers (acting as our service providers) that do not constitute “sales” to help us perform advertising-related functions such as, but not limited to, measuring the effectiveness of our ads, managing how many times you may see an ad, reporting on the performance of our ads, ensuring services are working correctly and securely, providing aggregate statistics and analytics, improving when and where you may see ads, and/or reducing ad fraud. Any opt out choices you make will only apply to the specific email address that you provide when making the request.

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Changes to This Notice

We reserve the right to amend this Notice at our discretion and at any time. When we make changes to this Notice, we will post the updated Notice on our Website and update the Notice's effective date. Your continued use of our Website following the posting of changes constitutes your acceptance of such changes.
